    Marriage Systems in South Africa

    Before getting married in South Africa, couples should understand the property system that will apply to their marriage. The choice affects assets, debts, business risk, inheritances, divorce and death.

    The main choices are marriage in community of property, marriage out of community of property with accrual, and marriage out of community of property without accrual.

    1. Marriage in community of property

    If you marry without an antenuptial contract, the default position is usually marriage in community of property. The spouses share one joint estate, including assets and liabilities, subject to the rules of that system.

    This can create risk where either spouse has debt, business exposure, suretyships or financial obligations that may affect the joint estate.

    2. Out of community of property with accrual

    Marriage out of community of property with accrual keeps the spouses’ estates separate during the marriage, but shares growth when the marriage ends. It is often a balanced option for couples who want protection and fairness.

    Commencement values, excluded assets, inheritances and donations should be handled carefully in the antenuptial contract.

    3. Out of community of property without accrual

    Marriage out of community of property without accrual creates stronger separation. Each spouse keeps their own estate and the growth of that estate, without sharing through the accrual system.

    This may suit second marriages, business owners, major wealth differences or estate-planning concerns. It should be chosen deliberately, because it can be harsh if one spouse gives up earning capacity or contributes in non-financial ways.
