    How Long Does an Antenuptial Contract Take?

    An antenuptial contract should be handled before the wedding, not after it. The drafting and signing can often move quickly when the couple’s information is ready, but the full process also includes notarial execution and Deeds Office registration.

    If the wedding is close, treat the ANC as urgent. Waiting until the last few days can create avoidable pressure and may limit the time available to understand accrual, exclusions, commencement values and the consequences of the contract.

    The short answer

    A simple ANC can often be prepared and signed relatively quickly once both parties have given clear instructions. Registration is a separate step. Under South African law, an antenuptial contract executed in South Africa must be attested by a notary and registered in a deeds registry within the required statutory period, unless a court allows an extension.

    In practice, the safer answer is: start as early as possible and do not leave the contract until the wedding week.

    The main steps

    1. Choose the marriage property system. Decide whether you are marrying in community of property, out of community with accrual, or out of community without accrual.
    2. Give instructions. Provide details about assets, debts, business interests, inheritances, exclusions and commencement values where relevant.
    3. Draft the ANC. The notary or attorney prepares the contract around the chosen structure.
    4. Review and sign. The parties must understand the effect before signing.
    5. Notarial execution. The ANC is executed before the notary.
    6. Registration. The contract is lodged and registered in the Deeds Office.

    What can delay an ANC?

    Delays usually come from uncertainty, incomplete information, wedding pressure or complexity. Common causes include:

    • the couple has not chosen between accrual and no accrual;
    • one spouse owns a business or has creditor exposure;
    • commencement values are missing or unrealistic;
    • assets, inheritances or family property must be excluded;
    • trust interests or offshore assets need attention;
    • the couple wants changes after the draft is prepared;
    • signing logistics or courier steps are delayed.

    When should you start?

    Start as soon as the marriage date is serious and the couple knows they do not want the default position of marriage in community of property. The earlier you start, the more time there is to understand the choices and avoid rushed drafting.

    What if the wedding is very soon?

    Do not assume it is too late, but act immediately. A notary or attorney will need to check whether there is enough time to take proper instructions, prepare the contract, arrange signature and deal with the registration process.

    Do not sign a document you do not understand simply because the wedding is close. The wrong matrimonial property system can have consequences for assets, debt, divorce, death and creditor exposure.

    Can you sign a prenup after marriage?

    An antenuptial contract is designed to be signed before marriage. If spouses are already married and want to change their matrimonial property system, that is not a normal late prenup. It is a formal legal process and generally requires a court route.

    This is why timing matters. It is much better to resolve the ANC before the wedding than to try to repair the position afterward.
